अब नेशनल डिफेंस एकेडमी परीक्षा में बैठ सकेंगी महिलाएं
महिलाओं को शामिल न करना यदि पॉलिसी डिसिजन तो यह भेदभाव से पूर्ण: सेना को लगाई फटकार: 0-सुप्रीम कोर्ट का अहम फैसला
नईदिल्ली, हाल ही में महिलाओं को परमानेंट सर्विस कमीशन में शामिल करने का फैसला देने के बाद अब सुप्रीम कोर्ट ने एक और बड़ी राहत दी है। सुप्रीम कोर्ट ने महिलाओं को अब एनडीए यानी नेशनल डिफेंस एकेडमी की परीक्षा में भी बैठने की अनुमति दे दी है। यह आदेश इसी साल सितंबर में होने वाली एनडीए की परीक्षा से लागू होगा। मामले की सुनवाई के दौरान सेना ने कहा कि एनडीए परीक्षा में महिलाओं को शामिल न करना पॉलिसी डिसिजन है। इस पर शीर्ष अदालत ने फटकार लगाते हुए कहा कि यदि यह पॉलिसी डिसिजन है तो यह भेदभाव से पूर्ण है। हालांकि 5 सितंबर को परीक्षा में बैठने का आदेश सुप्रीम कोर्ट के अंतिम निर्णय के अधीन होगा।
इससे पहले केस की सुनवाई के दौरान केंद्र सरकार ने मंगलवार को अपना पक्ष रखते हुए कहा था कि महिलाओं को एनडीए परीक्षा में मौका न देना, उनके मूलभूत अधिकारों के हनन का मामला नहीं है। यही नहीं केंद्र सरकार ने कहा था कि एनडीए के जरिए आने वाले पुरुष कर्मचारियों को उनके मुकाबले करियर में कोई स्पेशल बढ़त नहीं मिलती। महिलाओं के लिए सेना में एंट्री का एकमात्र रास्ता शॉर्ट सर्विस कमिशन ही रहा है। बता दें कि बीते दिनों ही शीर्ष अदालत ने सेना से महिलाओं को भी परमानेंट कमीशन में लिए जाने को कहा था। यही नहीं अदालत ने सेना के नियमों को गलत करार देते हुए कहा था कि ये बेतुके और मनमाने हैं।
दरअसल वकील कुश कालरा की ओर से महिलाओं को एनडीए और इंडियन नेवल अकादमी में शामिल किए जाने की मांग को लेकर अर्जी दाखिल की गई थी। उस याचिका पर सुनवाई करते हुए ही सुप्रीम कोर्ट ने यह फैसला दिया है। फिलहाल इन दोनों अकादमियों में महिलाओं की भर्ती नहीं की जाती। सुप्रीम कोर्ट ने इस अर्जी पर केंद्र सरकार से जवाब मांगा था। इस पर सरकार का कहना था कि यह अर्जी आम जनहित में नहीं है बल्कि एक पॉलिसी डिसिजन को लेकर ही है। इसी पर बुधवार को एक बार फिर से सुनवाई शुरू हुई, जिसमें जस्टिस संजय किशन कौल और ऋषिकेश रॉय ने महिलाओं के पक्ष में यह फैसला दिया है।
